Terms — Wildman Studio

A website designed and built for your business, put live on your own domain, hosted, kept online and kept up to date, for $249 a month. Nothing is paid before the site is live. There is no tax added, no setup fee and no deposit: $249 is the whole number.

The monthly fee covers the design and the build; hosting; registering or transferring your domain in your name and renewing it while the agreement runs; and changes after launch when you ask for them — text, prices, hours, photos, menus, a new page and the like, normally done within three business days. Larger work (a full redesign, online ordering or e-commerce, a booking system, a custom application, ongoing marketing) is not included; it is quoted separately in writing and only done if you approve the quote.

You see the finished design first. Nothing is built until you approve it, and nothing is billed until the site is live.

The first payment is due on the day the site goes live on your domain, and on the same day of each month after that. Payment is by pre-authorized card or bank debit, set up before launch; you agree to keep a valid payment method on file while the agreement runs. Any change to the monthly fee is given to you in writing at least 30 days before it takes effect.

If a payment fails, you will be told the same day and have seven days to fix it. After that the site comes offline until the account is brought up to date. If it stays unpaid for 30 days, Wildman Studio may end the agreement and take the site down for good. Nothing further is owed once that happens.

This is a month-to-month agreement from the launch date. There is no minimum term and no penalty for ending it. You can end it at any time, either by giving 30 days’ notice (email is fine) so the site comes down on a date you choose, or simply by stopping payment, in which case it comes down once the seven-day grace period runs out. Either way, nothing further is owed.

Because nothing is paid before the site is live, there is no deposit to refund. A month that has been paid for runs to its end; the site stays up until then.

If Wildman Studio ends the agreement for a reason other than non-payment, you get 30 days’ notice, help moving your domain, and nothing further is owed.

At any time you can buy the website outright for a one-time $2,500. Once it is paid, ownership of the site — its design, code and everything in it — transfers to you, the monthly fee ends, and so do Wildman Studio’s hosting and included changes. You are free to move it to your own hosting or another provider, and Wildman Studio will help with the move.

You own everything you give us: your business name, logo, words, photos, videos and any other content. You confirm you have the right to use them, and you keep the right to use them however you like. Your domain is registered in your name and is yours; if the agreement ends for any reason you keep it, and Wildman Studio will help you move it or leave it under your control.

The website itself — its design, code, layout and the way it is put together — and the hosting belong to Wildman Studio. You have the right to use the site for your business for as long as the agreement runs. When it ends the site is taken offline, and Wildman Studio has no obligation to hand over the code or design files — unless you have paid the buyout, in which case ownership passes to you as above. You can ask for a copy of any content you gave us, and of any text written for the site, at any time.

Wildman Studio may show the site in its own portfolio and marketing — screenshots, a link and your business name — unless you ask in writing that it does not.

Provide the content the site needs — words, photos, logo, hours, prices, contact details — and answer questions and approvals promptly, so the site can be built and kept accurate. Make sure what you give us is accurate, is yours to use, and does not break any law or anyone else’s rights. Keep your contact details and payment method current.

The site is hosted on a reputable platform and Wildman Studio will use reasonable efforts to keep it online. No hosting is perfect: short outages caused by the hosting platform, the internet, or things outside Wildman Studio’s control are not a breach of this agreement.

Search rankings, traffic, leads and sales depend on many things outside a website. Wildman Studio does not promise any particular ranking, number of visitors or business result.

Wildman Studio’s total liability to you under this agreement, for any reason, is limited to the fees you paid in the 12 months before the claim. Neither of us is liable to the other for indirect or consequential loss, such as lost profits. Nothing here limits liability for anything that cannot be limited by law.

Changes to these terms for your site are only binding if written and agreed by both of us (email is fine). These terms are governed by the laws of Ontario and Canada; if we ever disagree, we will talk first, and if that fails the courts of Ontario have jurisdiction. This page is the whole agreement between us about the website and replaces anything said or written before it. You may not transfer the agreement to someone else without Wildman Studio’s written agreement, which will not be unreasonably withheld — for example, if you sell the business.

Prices, availability and the details of the offer on this site can change; the terms that apply to you are the ones on this page on the day your site goes live, and any later change is given to you in writing 30 days ahead.
